In 1996/97, The Quarry Committee of Lummi Island challenged the expanding scope of operations before the Whatcom County Hearing Examiner. The quarry was ultimately limited to a maximum 19.5 acres when a Mineral Resource Lands zone change was approved by the Whatcom County Council in 1997.
